The master diverts after a threat report makes the planned approach unacceptable. The replacement port is farther from the affected lane and available within the operating window. The security decision is sound. The voyage was also screened before departure, so the bridge expects the compliance position to travel with it.
That expectation fails when the new port brings a different agent, bunker supplier and bank. Guard disembarkation may now occur under another coastal regime. The safer route has created a different transaction while the ship is already moving.
Freeze the approved voyage before comparing the diversion. A prior clearance becomes unreliable when nobody can say which facts supported it. Preserve the screened parties, ownership evidence, cargo, services, route, ports, currency, banks and governing lists. Then mark every field the diversion changes.
This comparison belongs in the route decision. If you wait for the port call, the local service may already be supplied and the payment instruction released. Security can choose the safer course while compliance pauses only those new acts that still lack support.
Keep the three maritime maps separate. A common shaded area invites a common conclusion, although each product answers a different question. BMP material supports threat and risk assessment. A voluntary reporting area tells you where a liaison scheme requests reports. A Joint War Committee Listed Area tells an underwriter where cover may need review.
The boundaries can move independently. Industry removed the Indian Ocean High Risk Area at 0001 UTC on 1 January 2023 while leaving the UKMTO Voluntary Reporting Area unchanged. As of 27 August 2026, UKMTO asks for an initial report, a daily report at 0800 UTC and a final report. As of the same date, the Joint War Committee said rating remained for underwriters and brokers to negotiate.
Record the issuer, edition, boundary and decision attached to each map. A removed risk label does not cancel reporting. A listed underwriting area does not prohibit entry. Neither decides whether the replacement agent can lawfully receive payment.
Incident totals cannot replace those maps. IMO recorded 146 piracy and armed-robbery incidents in 2024, including 91 in the Straits of Malacca and Singapore. ReCAAP ISC counted 107 Asian incidents that year: 2 piracy incidents, 105 armed robberies, 96 actual events and 11 attempts. It placed 62 incidents in the same straits.
The different totals reflect geographic scope, receipt and classification processes. They do not by themselves show an error, and neither series forecasts the next port call. Use each dataset for the question its method supports. Then use the current BMP material, reporting notice and insurance instrument for the diversion decision.
Identify the centre for the changed geography. A report can fail operationally because it reaches a respected body without the local coordination role. IMO MSC.1/Circ.1601 points Gulf of Guinea reporting towards MDAT-GoG and recognises ReCAAP ISC’s information-sharing role in Asia. Use the centre promulgated for the actual route.
Regional reporting also leaves national authority in place. It can distribute awareness without transferring a coastal State’s criminal, port or weapons powers. Your diversion record should therefore name the centre contacted and the separate authorities whose permission still governs the call.
Recheck flag, port and coastal permissions independently. Guard approval is especially easy to carry beyond its legal boundary. UK guidance covers qualifying internationally trading UK-flagged passenger ships and cargo ships of 500 gross tonnage and above. That scope does not authorise another flag or port.
Liberia required administration assessment and authorisation of private maritime security companies serving Liberian-flagged vessels from 1 September 2022. India’s 2011 port guidance required arriving ships with guards to disclose personnel, firearms and licences to Indian authorities. A changed port can therefore alter lawful disembarkation, storage and disclosure even when carriage remains acceptable to the flag.
Treat embarkation, transit, storage and disembarkation as separate events. Check the provider as well as the weapon permission. The revised route may introduce a new guard launch, armoury, handler or invoice, and each becomes part of the sanctions case.
Rebuild the whole transaction around the new call. Screening only the replacement port agent fails because ownership, services and payment may sit elsewhere. The European Commission’s 2023 guidance organises enhanced review around direct and indirect stakeholders, transactions, goods and end users. The diverted voyage needs the same depth.
List the owner, charterer, vessel, ship manager, cargo interests, consignee, agent, terminal, tug, bunker supplier, guard provider, insurer and banks. Trace relevant ownership and control. Record the cargo, end use, services, route, currency and correspondent path. OFAC’s 2019 framework treats customers, products, services, counterparties, intermediaries and geography as risk inputs.
A supplier may be unlisted while owned by a blocked person. A local-currency invoice may acquire a US nexus through a US financial institution. The port change can also bring territorial or sectoral measures that no party-name search will find.
Use an alert to stop the changed act. A score feels decisive under time pressure because it produces a number. OFAC’s search tool uses 100 for an exact match and lower scores for potential matches. The score still answers similarity rather than legal status.
OFAC FAQ 5 uses a five-step review for a possible live-transfer match. Identify the source list, compare entity type and full name, collect the remaining identifiers, then assess them together. Retrieve addresses, nationality, registration details and aliases. Document why the candidate matches or differs.
Continue into ownership after resolving the name. Under the US OFAC general rule, direct and indirect blocked ownership aggregates at 50% or more. Control alone does not automatically block under that rule. Another jurisdiction may use a different ownership or control test, so name the regime beside the conclusion.
Test the act against the exact measure. A true identity match still does not tell you what must happen. Under US practice, an SSI entry carries directive-specific restrictions rather than automatic blocking. The controlled act may instead be a payment, service, financing term, import, export or dealing with blocked property.
Read the regulation, order, directive and applicable authority. OFAC recognises two licence forms: a general licence for a transaction class and a specific licence for a particular applicant and transaction. Every condition still applies. Translate route, account, service, expiry, reporting and record conditions into instructions before the ship commits to the call.
Rescreen when a fact changes, not after a calendar interval. An approval describes one transaction state. Reopen it when the route, port, counterparty, bank, currency, ownership fact, service, cargo fact, payment path or governing list changes. Recheck before ordering the new service and again before releasing its payment if either stage introduces another party or nexus.
Keep navigation, service and payment statuses separate. The master may continue on the safer route while a new supplier remains on hold. A bank can make its own decision after receiving your analysis. Port entry, customs release or completed bunkering cannot supply permission to pay.
Close every branch with a named disposition. An alert left open after sailing becomes an undocumented assumption. Record a supported false-positive release, lawful licence or exception, rejection, blocking or commercial abandonment. State which changed acts may proceed and which must stop.
Under US OFAC practice, a prohibited transaction without a blockable interest is rejected and returned. Property with a blocked interest is frozen. US blocking and rejection reports are due within 10 business days under 31 CFR 501.603 and 501.604. Preserve the facts, searches, identifiers, ownership chart, measure, authority, approvals, bank action and report reference. That evidence is what makes the safer diversion defensible as both a security decision and a lawful transaction.
Keep the maritime evidence beside it: the threat report, route comparison, map editions, centre acknowledgements, flag instructions and port or coastal replies. The sanctions record then shows why each new party, service and payment entered the case.
