The convoy has consent from the state authority and the armed group controlling the destination. The cargo answers an assessed need. The bank then flags the transport payment, and the warehouse operator may be owned by a listed person. The departure clock is already running.
Humanitarian purpose cannot answer either sanctions question. A negotiated route concerns access. A sanctions authority concerns particular dealings with property, people, goods and services. You need both paths to clear the same package before the vehicles move.
Map the transaction before choosing the humanitarian measure. Teams reach for an exception too early because the word humanitarian appears in the programme description. That skips the facts which determine whether the measure covers the act. The European Commission’s 2023 EU guidance structures enhanced review around stakeholders, transactions, goods and end users. Use that discipline before reading the exception.
List the payer, supplier, carrier, warehouse, consignee, distributor, banks and intermediaries. Trace their owners and controllers. Record the cargo, transport, insurance, communications support, route, destination, currency and correspondent path. A free service or in-kind delivery can still make an economic resource available. A payment can acquire a US nexus when it passes through a US financial institution.
Run each ownership test in its own jurisdiction. A screening hit fails as legal analysis because an unlisted entity may still be restricted. The reverse error also happens. A minority holding can look decisive after somebody imports a foreign threshold that the governing regime does not use.
Under OFAC’s general US rule, blocked persons’ direct and indirect interests aggregate at 50% or more. OFAC’s own example combines two blocked owners holding 25% each. Control alone does not automatically block an entity under that general rule. Under the UK test, ownership means more than 50%, while board-majority appointment rights and practical control over affairs provide separate routes. OFSI does not simply aggregate unrelated sub-threshold holdings.
Apply those tests to every relevant actor, including the consignee and bank. Preserve the ownership chart and evidence date. Your legal conclusion should name the regime, bound person, property and prohibited act. “Cleared by screening” cannot tell the convoy lead which payment or delivery is lawful.
Match the relief authority to the actual prohibition. A humanitarian measure fails when its legal level, provider test or covered activity differs from the transaction. Resolution 2664 (2022) paragraph 1 permits specified humanitarian providers to supply funds, goods and services despite UN asset freezes. Paragraph 3 still requests reasonable efforts to minimise prohibited benefit and diversion.
That UN permission does not settle complementary national or regional restrictions by itself. The UK S.I. 2023/121 took effect on 9 February 2023 with actor and belief conditions. EU Regulation 2023/720 extended the Resolution 2664 exemption to specified complementary EU measures. On 20 December 2022, OFAC issued or amended four general-licence categories for humanitarian-related activity across multiple US programmes. Similar purpose produced different legal coverage.
Start with the prohibition that would otherwise stop the convoy. Then test the relevant exception or licence word by word. Record why the organisation, counterparty, payment, goods and services fall inside it. Where another applicable regime remains uncovered, redesign or obtain its authority before departure.
Read the licence as bounded authority. Urgency encourages teams to put the licence number on the file and treat the problem as closed. The underlying prohibition still governs everything outside the authorised envelope. Under US OFAC practice there are two licence forms: general licences cover transaction classes, while specific licences cover particular applicants and transactions. Their conditions must be strictly observed.
Build a short authority schedule beside the manifest. Extract authorised acts, parties, accounts, goods, services, purpose, start, expiry, reporting, records and other conditions. Link each planned transfer to the clause that permits it. A licence application supplies no interim authority. An expired licence supplies none for incomplete performance.
Keep access consent, legal clearance and notification as separate gates. Merging them creates false assurance. A local commander can permit passage without legal power to authorise your payment. A regulator can permit payment without making the road safe. A notification acknowledgement only confirms that information reached the mechanism.
Run the gates against one controlled convoy package. Version 2.0 of the November 2020 CCHN Facilitator Handbook uses Day 1 notice, authorisation within four days, T–1 reconfirmation and confirmation within three hours in its Annex 13 teaching sequence. Those intervals are examples. Their useful feature is the repeated comparison of current movement details with current authority.
The access owner records counterpart consent and field implementation. Legal records the prohibition and authority. The notification owner validates submitted movement data and acknowledgement. Departure needs each applicable gate, but one approval never substitutes for another.
Write reciprocal terms before the vehicles move. “Access granted” fails at the first checkpoint because it assigns no acts to the people who must perform them. State the route, schedule, cargo, inspection method, driver documents, field contacts and distribution arrangement. State who sends instructions to checkpoint staff and who resolves a mismatch.
Keep institutional red lines separate from negotiable bottom lines, as the CCHN method’s two limit types require. Prohibit diversion, discriminatory selection, weapons in the distribution, unlawful payment and separation that defeats safe return. Additional Protocol I Article 70 permits technical arrangements including search, while restricting diversion and delay. That boundary gives you a basis for an inspection protocol without accepting every roadside demand.
Make safe return part of the permission. Entry alone can strand staff, vehicles or unused cargo after the outward assurance expires. Write counterpart commitments for the return route, checkpoint instructions, communications, breakdown, medical diversion and withdrawal. Name the person who can suspend distribution and start the return.
Historical guidance shows why local implementation needs its own terms. The April 2019 South Sudan convoy guide invoked a November 2017 decree, still anticipated numerous checkpoints and required all vehicles to stop after a breakdown. It also requested two post-trip observations: checkpoint count and total trip cost. These were controls for that setting, not standing permission elsewhere.
Stop at an unapproved fee or benefit. A small roadside demand feels operationally easier than delay. It may change the payee, purpose and legal character of the transaction. A 2019–2021 South Sudan study mapped 319 checkpoints and found humanitarian-aid vehicles taxed at 157, or 49%. The prevalence in that study does not authorise payment in your case.
Use the written wait-and-escalate route. Identify who demands value, for whose benefit, under what asserted authority and through which payment method. Compare those facts with the sanctions analysis and access red lines. The convoy leader may continue only when the act is lawful and within delegated authority.
Reclear every material change. Clearance fails silently when operations change one field after legal review. A replacement carrier brings new ownership. A different bank brings another financial-system nexus. A changed route may cross another territorial measure. A substituted consignee changes the recipient and end user.
Put route, bank, currency, carrier, consignee, cargo, service, measure and licence expiry under change control. Recheck the full package whenever one changes. Reconfirm negotiated consent and notification data where the same change affects them. The November 2020 teaching sequence’s T–1 check shows the operating habit: compare the package again near movement, rather than trusting the date on an earlier approval.
Close the transaction with evidence. Departure is an intermediate state. Reconcile the manifest, payment evidence, checkpoint record, distribution record, unused goods and safe return. OCHA’s access database is designed to record three things: constraints and impact, restrictive policies, and action taken to overcome them.
Keep the licence analysis and conditions with that operational record. S/2022/51 identifies five notification controls: accuracy, acknowledgement, updating, incident reporting and follow-up. If US property was blocked or a transaction rejected, 31 CFR 501.603 and 501.604 require reporting within 10 business days. The closeout should show which rule applied, what happened, who reported it and whether the next convoy needs a different package.
