The programme director wants an access adviser in a border province. The candidate knows the country and accepts the violence, poor medical access and communications failures described in the brief. The travel coordinator asks for a signature before booking.
That signature changes the evidence. It shows what the candidate heard, which limits were disclosed and whether the decision was free. It cannot repair a weak mission, an unsuitable candidate or support that will not work in country.
The reason is control. Your organisation selected the work, set its purpose and can delay, narrow or stop it. Consent leaves those choices where they already sit.
Open with the work decision. Consent arrives too early when a booking request is the first complete description of the deployment. The candidate then appears to accept a trip whose role, movements and support have never been settled.
Write the proposition before buying travel. Name the role, candidate, mission, location, duties, likely movements, living conditions, counterparties and reason remote delivery cannot work. Give a manager provisional ownership of the risk. Selection and preparation can then test a defined operation.
Your provisional risk owner also needs a hold point. Require that person to accept the control plan, any authorised exceptions and the final residue before release. If the mission changes, you return the decision to that owner. The candidate’s acceptance informs the decision but cannot supply missing organisational authority.
Treat consent as a record of residue. A broad acknowledgement fails because it merges hazards the organisation can reduce with exposure left after reasonable precautions. The worker cannot tell which part they are accepting. The organisation cannot show which part it retained.
Record the material residual exposure, each working control, known support limit, expected conduct, pause route and consequence of declining. Under UK Unfair Contract Terms Act 1977 Section 2, awareness alone does not establish voluntary acceptance, and negligence liability for death or personal injury cannot be excluded by a term or notice.
Pressure also changes the record. Shatwell [1964] UKHL 2 treated social or economic pressure as a reason voluntary assumption can be unsuitable in employment cases. Give the candidate a confidential route, time to decide and a real option to decline without an improvised penalty.
Keep organisational precautions with the organisation. A signed form fails when it becomes evidence that the worker now owns transport, medical readiness or emergency communications. Those arrangements depend on budgets, contracts and authority the worker does not hold.
ILO Convention No. 155 Articles 16 and 18 place reasonably practicable safety and emergency measures with employers. The older Wilsons & Clyde Coal formulation covers competent staff, adequate material, a proper system and effective supervision. Its personal obligation is satisfied by due care and skill, rather than guaranteed safety.
Workers still carry duties of conduct. In Australia’s Commonwealth WHS Act 2011, Section 28 requires reasonable care and cooperation. Section 14 makes duties non-transferable. Record both sides without using one to erase the other.
Test the person against the mission. Generic willingness hides person-specific exposure. Experience, language, judgement, health restrictions, caring duties and earlier trauma can change what reasonable preparation requires. A candidate can freely accept the brief and still be unsuitable for that work as designed.
Start medical preparation while it can alter the plan. The CDC 2026 Yellow Book recommends consultation at least 4–6 weeks before departure for travellers with chronic conditions. Managers need restrictions and accommodations. They do not need the diagnosis used to reach them.
A HEAT certificate also has a narrow meaning. The ESDC curriculum is labelled 40h, while its table contains 41 scheduled working hours, including 6 hours of basic life support. Completion does not prove readiness for the current first movement, local medical delay or communications plan.
Authorise compression as an exception. Urgency conceals missing controls when everybody treats departure as the fixed fact. Tasks then disappear from the record and return as surprises after arrival.
The CDC 2026 Yellow Book describes last-minute international travel as typically inside 2 weeks. Mark that case explicitly. List what is complete, missing, substituted, deferred or impossible. Name the authoriser, narrow the task where needed, and make every substitute expire at a stated hold point.
A remote clinical consultation may substitute for part of a delayed preparation step. It cannot create a competent first responder, a receiving facility or reliable communications. Consent should state that remaining gap after the substitute has been tested.
Build the allegation as a causal chain. Foreseeability alone produces an unbounded account of responsibility. A known kidnapping risk may affect workers, residents and visitors, while the organisation controls only some activities and precautions.
For each alleged omission, ask three linked questions. Identify the control the organisation held. Identify the precaution available at the time. Then state the counterfactual: the precaution probably would have prevented this injury under the governing test.
Cassley [2015] EWHC 722 concerned a 2010 aircraft crash that killed the employee and 10 other people. The court found the employer’s inquiries insufficient but dismissed the claim for failed causation. The missing inquiry did not cause him to board or cause the accident.
That discipline improves a live decision as well as a later claim. “Security assessment missing” describes a process gap. “A suitable assessment would have rejected this carrier and prevented boarding” states the precaution and the counterfactual that need evidence.
Establish the governing regimes. Headquarters law feels convenient because the employer chose it for policies and contracts. Cross-border injury does not follow one connecting rule for every claim.
For EU Member States bound by Rome I Regulation 593/2008, Article 8 protects non-derogable employee law and ordinarily keeps the habitual-work country during temporary work abroad. Rome II Regulation 864/2007 Article 4 generally selects the country where direct damage occurs. Article 3 applies the selected law universally.
Map contract, tort, host-state safety law and compensation separately. Then check territorial reach. US OSH Act Section 4, 29 USC 653, covers workplaces in listed US areas and specified Outer Continental Shelf lands. It does not become a worldwide code because the employer is American.
The UK’s Corporate Manslaughter and Corporate Homicide Act 2007 has another boundary. Section 28 requires the death-causing harm to be sustained in specified UK-connected territory, ships, installations or aircraft. A UK headquarters does not replace that location test.
Make field support prove the consent remains current. A departure signature decays when the task, route or medical access changes. The worker accepted defined residue, while a changed operation creates a different exposure.
Use arrival induction to verify contacts, communications, accommodation, vehicles, clinical access and stop-work authority. In Australia, the model Code of Practice addresses remote or isolated work in Section 4.2 and requires communication and emergency arrangements. It prescribes no universal check-in interval, so you must select one from the actual isolation and consequence.
Give the deployer both a management review route and a confidential route. Extensions require a new decision. Familiarity, sunk cost and an earlier signature provide no evidence that the controls still work.
Separate learning from care on return. A compulsory emotional recounting contaminates operational review and can turn access to care into a performance event. People then manage what they say instead of identifying failed controls or seeking confidential help.
Run a factual lessons review on routes, decisions, equipment, support and handover. Offer clinical support separately. WHO strongly recommends against psychological debriefing to prevent post-traumatic stress, anxiety or depressive symptoms after recent trauma, based on very-low-quality evidence.
Keep a later confidential contact available. A longitudinal study followed 212 aid workers before deployment, 169 after deployment and 154 at 3–6 months. Depression and psychological distress remained elevated at that later point.
Consent remains useful through the whole cycle when it stays attached to a defined decision. It records what the deployer accepted. Your system must still show who controlled the work, which precautions were reasonable, whether they would have changed the outcome, and which law supplies the test.
